CONDICIONES DE COMPRA Y DEVOLUCIÓN (ESPAÑOL)

PRODUCTOS PERSONALIZADOS

1. Para adquirir un producto personalizado con Marianloveshoes debe realizarse una confirmación de pedido previamente, que será de 200€ para todos los modelos de tacón, 150€ para las bailarinas y 100€ para los zapatos de bebé y zapatos de otras marcas. Esta cantidad se descontará posteriormente del presupuesto final. Este primer pago corresponde al trabajo de creación y diseño del boceto y a gastos administrativos y de gestión del pedido. Esta confirmación también supone una reserva de fechas en nuestro calendario para llevar a cabo todo el proceso. En el caso de zapatillas Converse, se aplica un precio fijo para la zapatilla, el proceso de bocetaje y personalización. Es decir, se trata de un precio fijado y las zapatillas serán adquiridas por Marianloveshoes, a no ser que se acuerde lo contrario. Este importe deberá abonarse integramente antes de comenzar el proceso, para que Marianloveshoes pueda adquirir el producto de Converse.  Para el resto de productos, el presupuesto se explica en el punto 6.

2. Si el client@ adquiere uno de nuestros diseños, y si el client@ lo estima necesario, los zapatos podrán ser enviados para prueba al domicilio del cliente para confirmar la talla y que el modelo queda perfecto. Este envío y recogida del producto se realiza con nuestra empresa de mensajería y está incluido dentro del precio total del producto. Los envíos extras para pruebas correrán a cargo del cliente a razón de 7,50€ por trayecto. La dirección de envío y recogida no podrá ser modificada, siendo responsabilidad del cliente tener disponible el paquete para el mensajero cuando se estime oportuno. El préstamo de los zapatos de prueba no excederá los cinco días. El client@ deberá cuidar los zapatos enviados para pruebas de forma correcta. En caso de que los zapatos se devuelvan con desperfectos ocasionados durante las pruebas, tendrá un coste adicional de 114,50€ por par en concepto de valor unitario bruto.

3. En el proceso de personalización, primero creamos un boceto previo en papel con todas las ideas para que puedas visualizarlas y puedas hacerte una idea de cómo quedará sobre los zapatos. Hasta que no se confirma el boceto por ambas partes, no se comienza a pintar los zapatos. El boceto con las ideas para la personalización se puede modificar hasta tres veces antes de dibujarlo sobre los zapatos. Cada modificación extra tendrá un coste adicional de 12€. El proceso de bocetaje se llevará a cabo de acuerdo con nuestro calendario. Realizar la confirmación de pedido no implica que se empiece a realizar el proceso artístico, sino simplemente la reserva de fecha en nuestro calendario.

4. Si se cancela el pedido una vez probados los zapatos y empezado a trabajar en el diseño del boceto, se devolverá la confirmación de pedido menos 40€ en concepto de gestión administrativa. Los gastos de envío también correrán a cargo del cliente a razón de 7,50€ por trayecto. Si el pedido se cancela tras probarse los zapatos, pero no se ha empezado a trabajar sobre el boceto ni hemos hablado de las posibles ideas y creación artística, el importe de la confirmación de pedido será devuelto íntegro a excepción de los gastos de envío.

5. Si ya se ha enviado y/o confirmado el boceto por parte del client@ y por cualquier motivo externo a Marianloveshoes se decide no continuar con el pedido, el pago previo de confirmación de pedido no será devuelto en su totalidad.

6. Los precios de los productos personalizados de Marianloveshoes oscilan en un rango de precios ya que el precio final depende de la dificultad del boceto y de las horas de trabajo que se necesiten para crearlo y llevarlo a cabo sobre los zapatos. Esto quiere decir que el presupuesto final no se conocerá hasta que el boceto previo no está definido y acabado. Por lo tanto, el presupuesto final se enviará junto con el boceto final especificando todos los detalles del pedido y los gastos extras si se han generado. Este presupuesto deberá ser abonado por el cliente antes de entregar el producto. Esto no ocurre en el caso de Converse como se especificó en el punto 1.

7. No se enviarán fotos del proceso ni del resultado final antes del pago total del pedido. Marianloveshoes se reserva el derecho de realizar fotos y vídeos de los zapatos y del proceso artístico que podrá compartirse en redes siempre tras el evento en el que el client@ vaya a usar el producto.

8. Los productos personalizados no admiten devolución. El derecho de desistimiento y devolución que el consumidor tiene por ley no es aplicable en el caso de productos que han sido personalizados. Si ha adquirido un bien confeccionado conforme a sus especificaciones, lo ha elegido libremente y se trata de un producto claramente personalizado. No se podrá ejercer la devolución del mismo, salvo que el producto no cumpla con las condiciones contratadas o esté defectuoso. Una vez confirmado y aceptado el boceto definitivo por parte del client@ y comenzado el proceso de pintura no se podrán realizar modificaciones sobre el diseño, ya sean debidas a un cambio de opinión o a un error por parte del cliente. Únicamente se admiten devoluciones si el producto sufre un defecto de fábrica y, por lo tanto, es un producto defectuoso. En este caso, una vez recibido el producto, el client@ dispone de 14 días hábiles para ejercitar el derecho de devolución. Deberás comunicar el motivo de tu devolución previamente mediante un email a hola@marianloveshoes.com. Marianloveshoes se reserva el derecho de solicitar pruebas fehacientes como fotografías para comprobar el motivo de la devolución. Una vez confirmada la devolución, Marianloveshoes se hará cargo de los costes asociados a esta devolución y/o cambio. Dadas estas circunstancias, Marianloveshoes siempre ofrecerá cambiar el par por otro par antes de la devolución. Si aún así, el client@ decide recibir una devolución, nos reservamos el derecho de retener el reembolso hasta recibir el producto.

Al aceptar la confirmación de pedido o factura y realizar el pago inicial o total se aceptan estas condiciones de compra.

PRODUCTOS NO PERSONALIZADOS

1. Para adquirir un producto no personalizado de Marianloveshoes deber realizarse la compra íntegra del mismo y abonarse también los gastos de envío de 7,50€ previo al envío del producto.

2. Si cuando el Client@ reciba el producto, la talla no es la adecuada, Marianloveshes recogerá y enviará otra talla sin gastos adicionales para el cliente.

3. En el caso de que el cliente no desee el producto tras probárselo, se devolverá el importe íntegro excepto los gastos de envío de 15€ en concepto de envío y recogida (7,50€ por trayecto). Nunca se realizará ninguna devolución antes de recibir de vuelta el producto. Si el producto es devuelto defectuoso, se cobrarán 114,50€ por par en concepto de valor unitario bruto.

4. En el caso de que la devolución sea por causas no imputables a nuestra marca como cambios de color, talla u otras características, que sean debidos a un cambio de opinión o error por parte del client@ a la hora de hacer la compra, se descontará una tasa por gastos administrativos de 15€, además de los gastos de envío de 15€ en concepto de envío y recogida (7,50€ por trayecto). El client@ nos informará por email en un plazo no superior a 14 días hábiles desde la realización de la compra. Una vez recibidos los zapatos de vuelta, si están en perfecto estado, se procederá con el reembolso de la cantidad correspondiente.

Al aceptar la factura total del pedido y realizar el pago de ésta, el client@ acepta estas condiciones de compra.

PURCHASE AND REFUNDS POLICY (ENGLISH)

CUSTOM SHOES

1. To purchase personalized shoes with Marianloveshoes, an order confirmation must be made in advance, which will be € 200 for all heel models, € 150 for ballerinas and € 100 for baby shoes and shoes from other brands. This amount will subsequently be deducted from the final budget. This first payment corresponds to the work of creation and design of the sketch and administrative and management costs of the order. This confirmation also supposes a reservation of dates in our calendar to carry out the whole process. In the case of Converse shoes, a fixed price applies for the shoe, the sketching process and customization. In other words, this is a fixed price and the shoes will be purchased by Marianloveshoes, unless otherwise agreed. This amount must be paid in full before starting the process, so that Marianloveshoes can purchase the Converse product. For the rest of the products, the budget is explained in point 6.

2. If the client acquires one of our designs, and if the client deems it necessary, the shoes may be sent to the client to try on. This way we will confirm the correct size and that the model fits well. This shipping and collection of the product is done with our courier company and is included in the total price of the product. Extra shipments to try the shoes will be borne by the customer at the rate of € 7.50 per journey. The shipping and collection address cannot be modified, being the responsibility of the client to have the package available to the courier when agreed. The loan of the trial shoes will not exceed five days. The client must take care of the shoes sent correctly at all times. In the event that the shoes are returned with damage caused during the tests, it will have an additional cost of € 114.50 per pair of shoes as gross unit value.

3. In the customization process, first we create a preliminary paper sketch with all the ideas so that you can visualize them and get an idea of how it will look on the shoes. Until the sketch is not confirmed by both parties, we won’t begin the process of painting. The sketch with the ideas for personalization can be modified up to three times before drawing it on the shoes. Each extra modification will have an additional cost of € 12. The sketching process will be carried out according to our calendar. Making the order confirmation does not imply that the artistic process begins, but simply the date reservation in our calendar.

4. If the order is cancelled once the shoes have been sent to try and we have started to work on the design of the sketch, an administration fee of € 40 will be deducted from the order confirmation before it’s reimbursed. Shipping costs will also be borne by the customer at the rate of € 7.50 each way. If the order is cancelled after trying on the shoes, but no work has been started on the sketch nor have we discussed any possible ideas and artistic creation, the amount of the order confirmation will be returned in full, except for shipping costs.

5. If the sketch has already been sent and confirmed by the client and for any reason external to Marianloveshoes it is decided not to continue with the order, the previous payment for the order confirmation will not be returned in full.

6. The prices of Marianloveshoes’ personalized shoes include a price range since the final price depends on the difficulty of the sketch and the hours of work needed to create it and paint it on the shoes. This means that the final budget will not be known until the previous sketch is defined and finished. Therefore, the final budget will be sent together with the final sketch specifying all the details of the order and the extra expenses if it is the case. This budget must be paid by the client before delivering the shoes. This does not occur in the case of Converse as specified in point 1.

7. No photos of the process or the final result will be sent to the client before the total payment of the order is covered. Marianloveshoes reserves the right to take photos and videos of the shoes and the artistic process that can be shared on networks always after the event in which the client is going to use the product.

8. Returns do not apply for customized products. The right of withdrawal and return that the consumer has by law is not applicable in the case of products that have been personalized. If you have purchased a good made according to your specifications, you have chosen it freely and it is a clearly a personalized product. Returns are not applicable, unless the product is different from the contracted conditions or it is defective. Once the final sketch has been confirmed and accepted by the client and the painting process has begun, no changes can be made to the design, either due to a change of opinion or an error by the client. Returns are only accepted if the product is defective from the factory. In this case, once the product is received, the client has 14 business days to exercise the right of return. You must communicate the reason for your return in advance by email to hola@marianloveshoes.com. Marianloveshoes reserves the right to request reliable evidence such as photographs to verify the reason for the return. Once the return is confirmed, Marianloveshoes will bear the costs associated with this return and / or change. Given these circumstances, Marianloveshoes will always offer to change the pair of shoes for another pair prior to a refund. If even so, the client decides to receive a refund, we reserve the right to withhold the refund until we receive the product.

By accepting the order confirmation and making the initial payment or full invoice, the client accepts these purchase conditions.

NON-CUSTOM SHOES

1. To purchase a non-personalized Marianloveshoes product, the entire purchase must be made and the shipping costs of € 7.50 must also be paid prior to shipping the product.

2. If, when the client receives the product, the size is not correct, Marianloveshes will collect and send another size at no additional cost to the customer.

3. In the event that the customer does not want the product after trying it on, the full amount will be refunded, except for the shipping costs of € 15 for shipping and collection (€ 7.50 each way). No refund will be made before receiving the shoes back. If the shoes are returned defective, an amount of € 114.50 per pair will be charged as gross unit value.

4. In the event that the return is due to causes not attributable to our brand, such as changes in colour, size or other characteristics, which are due to a change of opinion or error by the client when making the purchase, an administrative fee of € 15 will be deducted, in addition to the shipping costs of € 15 for shipping and collection (€ 7.50 each way). The client will inform us by email within 14 business days from the purchase. Once the shoes are received back, if they are in perfect condition, the corresponding amount will be reimbursed.

By accepting the total invoice of the order and making the payment thereof, the client accepts these purchase conditions.
